In Texas, man gets 4 mos. for killing wife, 15 yrs for wounding man

FORT WORTH, Texas (AP) -- A man sentenced to just four months in prison for killing his wife, after a jury concluded he acted in a blind fury, drew a 15-year term for wounding her boyfriend.

Jimmy Dean Watkins pleaded guilty Wednesday to attempted murder for shooting Keith Fontenot on December 22, 1998. Watkins' estranged wife, Nancy, was killed with multiple gunshots as she tried to dial 911 during the attack.

The jury at his 1999 trial found Watkins guilty of murdering his wife but decided he acted with "sudden passion" when he discovered her with Fontenot.

In a decision that provoked an outcry, the jury recommended 10 years' probation. Because of the jury's recommendation, the most the judge could have given Watkins was six months behind bars. He sentenced Watkins to four months.

Another wrinkle was added to the case in 2003, when two defense witnesses who gave key testimony pleaded guilty to perjury. They had claimed that Nancy Watkins and Fontenot had taunted Watkins in the hours before the shooting.

The Watkinses' son, Eric, now 16, glared at his father in court Wednesday and testified that he wished his last memory of his mother was not seeing her dying on the kitchen floor.

"I will never call you Dad again," the boy, now Eric Braley, told Watkins. A year after his mother's death, he was adopted by his former school counselor and her husband.

Watkins had admitted the attack but claimed temporary insanity. Texas defines "sudden passion" as being so overcome by rage, resentment or fear that the defendant is "incapable of cool reflection." Jurors said they recommended probation because they didn't think Watkins could be rehabilitated in prison.

I am from Texas and I don't understand the way they do things here. Hell If you get caught with a little dope they try to gas you lol :lol: Seriously I do think that the legal system needs a overhaul.. Thanks for bringing this out So people can talk about it..Don P.

Im from Ft Worth,Tx myself, Hell I dunno its Texas for ya..Things are so messed up here its not even funny.I got a cerfew violation and I was 21 when I got it.I paid it in 98 and now 2005 they issue a warrant for my arrest.Hell I paid it and It was in warrant since 98 but the kicker is I have been stopped and my name ran many of times looking for warrants and stuff.Not once did they find the warrant.But yet I paid it wasn't happy but I did...Texas sucks!!!!! PLM

You don't know shit about shite. I lived in Austin in the late 80's and you were allowed to drive around with an open beer in one hand and a loaded .45 in the other. And you could sip your beer at the traffic light in plain view while you wave to the cop next to you. And I hardly ever saw an accident and there were no more shooting incidents than there were in any other state. Texas didn't go downhill until Bush fucked it up in the 1990's, and if Dubya fucking up the government is reason to fire Texas, than how the fuck do you let the rest of the country off, now that's he's fucked up the federal government as well? Stop using Texas as some sort of scapegoat. It is not their fault Bush was reelected. It's all your faults. Every one of you -- even those who voted for Kerry. You sat on your asses and just watched it happen. You want to blame any states, blame New York and Californina. They are the most Democratic states out there and they did shit to get the other states on board. Hell, they both even voted themselves a couple of Republican governors. And Texas did NOT give you George, moron. Your sissy-ass New England did. He merely fucked up Texas, the way he does everything he touches.

You're all worthless and weak and you got exactly the President you deserve. Don't you dare blame anyone else.

Well, I am in Texas And I am born and Raised Texan ..I think alot of the shit is really fucked ...Don't want iot to get us fired from the U.S. Of A. But who ever wrote all that shit about drinking in front of cops in Austin ...You need to get your head out of your ass.. Cause it Ain't and never was that way. Laws are screwed in practicaly all states so, we just need to learn to deal with them as we are faced with them.... Peace to all....Don P. B-)
